U.S. Senator Eric Schmitt (R-MO), who chairs the Post-Chevron Working Group, has authored a 150-page report that aims to influence the future of administrative law. The report is intended to guide the crafting of legislation designed to limit the authority of unelected officials in Washington.
Senator Schmitt stated, "The Loper Bright decision is one of the most consequential Supreme Court decisions in our nation’s history. The rise of the Administrative State has been antithetical to our Constitution and our republican form of government. In our system, the people elect their leaders." He emphasized concerns about bureaucratic power: "For too long, Washington bureaucrats have been transferring power from the will of the people and into the hands of unelected, unaccountable bureaucrats."
Schmitt also mentioned President Trump's administration as having made significant strides toward restoring accountability within the Executive Branch. He remarked on his role as Chairman, saying he is pleased to release a report that aims to guide Congress in reestablishing accountability and showcasing what he describes as failures during Biden's administration. The report also proposes changes for drafting future legislation.
